1. Introduction

Welcome to IT Connection Network ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at https://itcn.com.bd (the "Service") and all internet services provided by IT Connection Network.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Service Description

IT Connection Network is an Internet Service Provider (ISP) that offers various internet connectivity services across Bangladesh. Our services include, but are not limited to:

  • Home broadband internet connections
  • Corporate internet solutions
  • Dedicated internet access
  • BDIX connectivity
  • IP address allocation
  • Other related services

The specific features and limitations of each service package are described in the service agreement provided at the time of subscription.

3. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

4. Subscriptions

4.1. Service Subscription

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

4.2. Fees and Payment

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or IT Connection Network cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting IT Connection Network customer support team.

A valid payment method, including credit card, mobile banking, or other accepted payment methods, is required to process the payment for your Subscription. You shall provide IT Connection Network with accurate and complete billing information, including full name, address, state, zip code, telephone number, and valid payment method information. By submitting such payment information, you automatically authorize IT Connection Network to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, IT Connection Network will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

4.3. Service Activation

The service will be activated after successful payment of the connection fee and the first month's subscription fee. The activation timeline depends on the service area and technical requirements.

4.4. Fee Changes

IT Connection Network, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

IT Connection Network will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

5. Service Level Agreement

5.1. Uptime Guarantee

IT Connection Network strives to maintain a high level of service availability. We aim to provide 99.5% uptime for all our internet services. However, this may vary based on external factors beyond our control.

5.2. Service Interruptions

We may need to perform maintenance on our network infrastructure from time to time. Whenever possible, we will schedule maintenance during off-peak hours and notify customers in advance. Emergency maintenance may be performed without prior notice if necessary.

5.3. Speed Variations

The actual internet speed may vary based on various factors, including but not limited to network congestion, device capabilities, connection method (wireless vs. wired), and external website limitations. The speeds mentioned in our packages represent the maximum possible speed under optimal conditions.

5.4. Technical Support

IT Connection Network provides 24/7 technical support for all service-related issues. You can contact our support team via phone, email, or through our customer portal.

6. User Responsibilities

6.1. Legal Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

  1. In any way that violates any applicable national or international law or regulation.
  2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  3. To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
  4. To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  5. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful.

6.2. Network Security

Users are responsible for maintaining the security of their own devices and internal network. IT Connection Network is not responsible for any security breaches that occur due to the user's failure to properly secure their devices or network.

6.3. Bandwidth Usage

Fair usage policies may apply to certain packages. Excessive usage that affects the quality of service for other users may result in bandwidth management measures or require an upgrade to a higher package.

6.4. Equipment

Any equipment provided by IT Connection Network remains the property of the company unless explicitly stated otherwise. Users are responsible for maintaining the equipment in good condition and returning it upon service termination.

7. Termination and Suspension

7.1. Termination by User

You may terminate your subscription with IT Connection Network by providing written notice at least 7 days before the end of your current billing cycle. Upon termination, you must return any equipment provided by IT Connection Network in good working condition or be subject to equipment replacement fees.

7.2. Termination by Company

IT Connection Network reserves the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

7.3. Service Suspension

IT Connection Network may temporarily suspend services in the following cases:

  • Non-payment of fees within 7 days of the due date
  • Violation of the acceptable use policy
  • Detection of activities that threaten network security or stability
  • Government or regulatory orders

Service restoration after suspension may be subject to reconnection fees.

8. Limitation of Liability

In no event shall IT Connection Network, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the Service;
  2. Any conduct or content of any third party on the Service;
  3. Any content obtained from the Service; and
  4. Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

IT Connection Network's total liability for any claims under these Terms, including for any implied warranties, is limited to the amount you paid us to use the Service.

9. Indemnification

You agree to defend, indemnify and hold harmless IT Connection Network and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  1. Your use and access of the Service, by you or any person using your account and password;
  2. A breach of these Terms; or
  3. Content posted on the Service.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
